Terms of Service.

The rules of using Sphere — written to be read, not buried. Please go through them. They include an arbitration clause and class-action waiver.

i.Agreement

Welcome to Sphere. These Terms of Service (“Terms”) form a binding agreement between you and [Sphere, Inc., a Delaware corporation] (“Sphere,” “we,” “us”). By creating an account, downloading the app, or otherwise using the Service, you accept these Terms and our Privacy Policy.

If you do not agree, do not use Sphere.

ii.Eligibility

  • dot You must be at least 18 years old.
  • dot You must have the legal capacity to enter binding contracts in your jurisdiction.
  • dot You must not be barred from using Sphere under U.S. law or the law of your country of residence.
  • dot You must not be a registered sex offender.

iii.Your account

To use Sphere you create an account verified by your phone number. You agree to:
  • dot Provide accurate information about yourself.
  • dot Maintain only one account.
  • dot Not impersonate another person, real or fictional.
  • dot Keep your device and account secure. You are responsible for activity under your account.

iv.License to use Sphere

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the Sphere mobile application for your personal, non-commercial use.
You may not: copy, modify, reverse-engineer, or create derivative works of the Service; rent, lease, or sublicense it; remove or alter trademarks; or use the Service to build a competing product.

v.Acceptable use

Sphere is built on consent and discretion. You agree not to:
  • dot Use Sphere to harass, stalk, threaten, or intimidate any person.
  • dot Add the contact details of minors under 18 to your watchlist.
  • dot Use Sphere to coerce, blackmail, or extort.
  • dot Add identifiers you know to belong to a person who has restraining or no-contact orders against you.
  • dot Attempt to reverse-engineer hashes or otherwise probe whether specific people are on Sphere.
  • dot Bulk-add identifiers, scrape lists, or use automated tools to discover matches.
  • dot Upload illegal, sexually exploitative, hateful, or violent content in any conversation.
  • dot Use Sphere to facilitate prostitution, trafficking, or any illegal activity.
We may suspend or terminate accounts for violations without notice.

vi.SMS & Twilio

By providing your phone number and tapping “Send code” at signup, you consent to receive SMS messages from Sphere via Twilio. The categories, frequency, opt-in, and opt-out details are described in our Privacy Policy §5. In summary:
  • dot Program description: Sphere account verification, security, and mutual-match notifications, plus (opt-in only) product updates.
  • dot Categories of messages: verification codes, security alerts, mutual-match notifications, and optional product updates.
  • dot Frequency: message frequency varies; typically 1–3 messages per week. Verification codes are sent only when you initiate sign-in.
  • dot Carrier charges: message and data rates may apply per your carrier’s plan. Carriers, not Sphere, are responsible for such charges. Carriers are not liable for delayed or undelivered messages.
  • dot Supported carriers: all major U.S. carriers including AT&T, T-Mobile, Verizon Wireless, Sprint, U.S. Cellular, Boost, MetroPCS, Virgin Mobile, and others.
  • dot Supported carriers: all major U.S. carriers including AT&T, T-Mobile, Verizon Wireless, Sprint, U.S. Cellular, Boost, MetroPCS, Virgin Mobile, and others.
  • dot STOP:reply STOP, END, CANCEL, UNSUBSCRIBE, or QUIT to any Sphere SMS to opt out of non-essential SMS. You will receive one confirmation message.
  • dot HELP:reply HELP to any Sphere SMS for assistance, or email info@mysphere.love.
  • dot No resale:Sphere does not sell, share, or rent mobile information (including phone numbers and opt-in status) to third parties or affiliates for marketing or promotional purposes.
  • dot We never send SMS to people on your watchlist.
Your consent to receive SMS is not a condition of any purchase. Full SMS terms and our messaging policy are summarized at mysphere.love.

vii.Your content

You retain ownership of any content you create on Sphere (display name, profile fields, messages with matches). You grant Sphere a worldwide, royalty-free, non-exclusive license to host, store, transmit, and display this content solely to operate the Service.
End-to-end encrypted messages between matched users cannot be read by Sphere. We do not license, monetize, or train models on your messages.

viii.Payments & subscriptions

Sphere is currently free to use. Optional paid features may be introduced and will be billed through the Apple App Store under Apple’s standard terms. Any new payment terms will be presented to you before purchase.

ix.Termination

You may delete your account anytime via Settings → Account → Delete account (see §9b below) or by emailing info@mysphere.love. We may suspend or terminate your access if you breach these Terms, if required by law, or if we discontinue the Service. Sections that by their nature should survive termination (license restrictions, disclaimers, limitation of liability, indemnification, dispute resolution, governing law) survive.

ix-b.Account deletion & data purge

You can permanently delete your Sphere account and all associated personal data at any time, free of charge, without explanation.

How to delete

  • dot In-app: open Sphere → Settings → Account → Delete account. Confirm with your phone-verified one-time code. Deletion is initiated immediately.
  • dot By email: send a request to info@mysphere.love from the email address tied to your account, with subject line “Delete my account.” We will verify ownership of the account’s phone number before proceeding.

What we purge

Upon confirmed deletion, Sphere purges the following from active production systems:
  • dot Your verified phone number and optional Instagram handle.
  • dot Your display name, profile fields, and authentication credentials.
  • dot Your watchlist hashes and pending interest records.
  • dot Your match records, conversation metadata, and any end-to-end encrypted ciphertext stored server-side.
  • dot Device tokens, push notification identifiers, and analytics linkages to your account.

Timing

Deletion is initiated immediately and completed across all production systems within 30 days. Encrypted backups containing your data are rotated out within 90 days. After that window, your data cannot be recovered.

App Store users

This deletion process satisfies Apple App Store Guideline 5.1.1(v): account deletion is initiated from within the app, requires no phone call or external form, and results in full removal of account and personal data.

Limited retention

x.Disclaimers

The Service is provided “as is” and “as available” without warranty of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy.

Sphere does not guarantee that any specific person you add will join Sphere, will add you back, or will respond to a match. Sphere does not screen, vet, or background-check users. You are responsible for evaluating other users’ suitability and safety before meeting in person.

xi.Limitation of liability

To the maximum extent permitted by law, Sphere and its officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, whether based on warranty, contract, tort, or any other legal theory, arising from your use of the Service.
Sphere’s total liability for any claim arising from these Terms or your use of the Service will not exceed the greater of (a) USD $100 or (b) the amount you have paid Sphere in the 12 months preceding the claim.

xii.Indemnification

You agree to indemnify and hold harmless Sphere, its affiliates, and their respective officers, directors, employees, and agents from any claim, damage, loss, or expense (including reasonable attorneys’ fees) arising from (i) your breach of these Terms, (ii) your misuse of the Service, or (iii) your violation of any law or third-party right.

xiii.Arbitration & disputes

You and Sphere agree that any dispute arising out of these Terms or the Service will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, in [San Francisco, California]. You waive any right to a jury trial and to participate in a class action.

You may opt out of arbitration within 30 days of creating your Sphere account by emailing info@mysphere.love with subject line “Arbitration Opt-Out” and your account’s phone number. Small-claims court is available regardless of this clause.

xiv.Governing law

These Terms are governed by the laws of the State of [Delaware] and the federal laws of the United States, without regard to conflict-of-law principles. Where arbitration does not apply, exclusive venue lies in the state and federal courts of [San Francisco County, California].

xv.Changes

We may modify these Terms. Material changes will be announced in-app and via email at least 14 days before they take effect. Continued use of Sphere after changes take effect constitutes acceptance.
